Lucy Motta
Overview
Lucy manages a broad range of legal matters for Councils, particularly in relation to asset management, property, planning related, administrative and contractual issues. Prior to joining Wilshire Webb Staunton Beattie in 1985 Lucy worked with the Industrial Commission of NSW.
Relevant Experience
· Advice on local government administration and governance, telecommunications matters, asset management and tenancy issues
· Assist Council with conveyancing, resumptions, easements, covenants, leasing, licensing and other commercial transactions relating to land and roads
· affordable housing initiatives, voluntary planning agreements
· All facets of property and contract law for Councils
· Community land and plans of management, community title, strata matters and by-laws
· Commercial contracts, joint venture arrangements, and special purpose agreements, tenders and contracts
· Easements, covenants and caveats, including s88K Conveyancing Act litigation
· Land swap, road closure, opening, management, building and fit out contracts, native title cases and GST issues
· Planning Agreements and Debt Recovery advice
· Advice and acted in the Council litigation with Lehman Bros CDOs
· Advice to several Councils concerning contracts to implement practices for energy saving and greenhouse gas reduction, and on Councils’ legal obligations in relation to climate change
· Assists Councils draft covenants and restrictions for example to implement Council policies relating to greywater and blackwater treatment systems.
· Given extensive advices to many Councils in response to Developer contributions and Planning Agreements on major building sites throughout NSW.
